Terms and Conditions for the Provision of Services via the Luksor Sp. z o.o. website

Definitions:

1. Website – the website available at: https://luksor.eu, together with the services provided on it.
2. Luksor – Luksor Sp. z o.o., ul. Pasaż Ursynowski 9, unit 4B, 02-782 Warsaw, Poland.
3. Controller – the entity managing and providing the services available on the Website.
4. User – any natural person visiting the Website or using one or more services or functionalities available on the Website.
5. Terms and Conditions – these Terms and Conditions for the provision of services.

§1 [General Provisions]

1. These Terms and Conditions specify the rules for the provision of services via the website available at: https://luksor.eu, including the terms of use of such services, as well as the rights and obligations of Users.
2. These Terms and Conditions constitute the terms and conditions referred to in Article 8 of the Act of 18 July 2002 on the Provision of Electronic Services.

§2 [Controller]

1. The Controller of the Website is Luksor.
2. The Controller provides services based on these Terms and Conditions, and access to the Website and use of its content constitutes acceptance of these Terms and Conditions, which are binding on the User without the need to conclude a separate agreement.
3. If a User does not agree to comply with these Terms and Conditions, they should leave the Website.

§3 [Intellectual Property Rights]

1. All intellectual property rights, including copyrights and trademark rights relating to all texts, illustrations, photographs, sounds, and other materials published on the Website, are owned by Luksor or are used with permission from their respective owners.
2. Without prior consent of the Controller, the User is not entitled to download or further use any information or materials published on the Website.

§4 [Services]

1. The Controller provides the following services via the Website:
   
   1. displaying information about Luksor’s products and services;
   2. enabling contact with Luksor.
2. Access to the Website’s services is free of charge.
3. The Controller reserves the right to introduce fees for any services provided through the Website and undertakes to inform Users in advance of such changes and to obtain their explicit consent before introducing such fees.

§5 [Technical Requirements]

1. The technical requirements necessary for the User to use the Website are as follows:
   
   1. the User must have a computer or other device with access to the Internet;
   2. the User must use an up-to-date web browser: Mozilla Firefox version 3.0 or newer, Opera version 11.0 or newer, Google Chrome version 20.0 or newer, Safari version 5.0 or newer.
2. The Controller reserves the right to temporarily suspend the provision of services due to maintenance, upgrades, or modification of the Website or the ICT system on which it operates.
3. The Controller shall not be liable for interruptions in the provision of services caused by circumstances beyond its control.

§6 [Complaints and Liability]

1. The Controller shall make every effort to ensure the proper functioning of the Website and will provide assistance in resolving any issues related to its operation.
2. All complaints related to the functioning of the Website should be submitted:
   
   1. by email to: office@luksor.eu, or
   2. in writing to the address of Luksor.
3. Complaints should include:
   
   1. the User’s name,
   2. surname,
   3. email address or correspondence address,
   4. justification of the complaint.
4. Complaints will be considered within 14 calendar days from the date of receipt. If resolving the complaint requires more complex actions, the response period may be extended by an additional 30 days.
5. The Controller shall not be liable, under Chapter 3 of the Act of 18 July 2002 on the Provision of Electronic Services, for the content of information and opinions provided by Website users.
6. All materials and information published on the Website are provided without any guarantee of their value, usefulness, completeness, or accuracy.

§7 [Personal data]

1. The controller of personal data of users of the website https://luksor.eu is Luksor.
2. The Controller can be contacted by email at: office@luksor.eu or in writing at: Luksor Sp. z o.o., ul. Pasaż Ursynowski 9, unit 4B, 02-782 Warsaw, Poland.
3. The Controller has appointed a Data Protection Officer, who can be contacted by email at: iod@luksor.eu or in writing to the Controller’s address with the note “Data Protection Officer”.
4. All information regarding the processing of your personal data and the exercise of your rights is available in the Privacy Policy, available at: https://luksor.eu.

§8 [Final Provisions]

1. In matters not regulated by these Terms and Conditions, the provisions of the Act of 18 July 2002 on the Provision of Electronic Services and the Act of 23 April 1964 – Civil Code shall apply.
2. The Controller reserves the right to amend these Terms and Conditions unilaterally, if Users are informed in advance of such changes.
3. These Terms and Conditions are available on the Website.
4. This legal notice and the use of the Website are governed by Polish law.
